USER AND DATA USE AGREEMENT FOR THE UNIVERSITY OF FLORIDA
INFECTIOUS DISEASE OUTCOMES PROJECT
The following User and Data Use Agreement ("Agreement") governs the use of the www.IDOPWeb.com ("Website") and the data submitted via the Website.
In consideration of it’s participation in the Infectious Disease Outcomes Project, User Hospital (“Hospital”) agrees and understands that Hospital is a Covered Entity as defined in the enacting regulations of the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Hospital is providing the University of Florida Infectious Disease Outcomes Project (“IDOP”) with a Limited Data Set (“LDS”) of Protected Health Information (“PHI”) as defined in 45 CFR 164.514(e)(2), so that the IDOP is a Limited Data Set Recipient, as the term is used in 45 CFR 164.514(e)(1).
Hospital and IDOP will fully comply with HIPAA, and other state and federal laws related to confidentiality and information security.
Hospital will:
- exclude direct identifiers of patients and their relatives, employers, or household members
- not copy materials on the website
- not disclose password to unauthorized persons
IDOP will:
- limit the use and disclosure of the LDS to the activities described on this Website
- limit the use and disclosure of the PHI to those members of its workforce and any agents or subcontractors who have a legitimate business need to access the LDS for the activities described on this Website
- ensure that it, and any members of its workforce, who have access to the LDS will not use or further disclose the PHI other than as permitted by this Agreement, or as otherwise required by law or regulation
- ensure that any agent, including a subcontractor, to whom it provides the LDS, agrees to the same restrictions and conditions that apply through this Agreement to IDOP with respect to such information
- use appropriate safeguards to protect the PHI from misuse or inappropriate disclosure and to prevent any use or disclosure of the PHI other than as provided in this Agreement, or as otherwise required by law or regulation
- not attempt to identify the individuals to whom the PHI pertains, or attempt to contact such individuals
- report to Hospital any use or disclosure of the LDS not provided for by this Agreement of which it becomes aware, including, without limitation, any disclosure of PHI to an unauthorized subcontractor, within ten (10) days of its discovery
Any ambiguity in this Agreement will be resolved to permit Hospital to comply with HIPAA.
All materials available on the including Website, including without limitation text, data, images, software and downloadable software applications, audio and video clips, and databases, (collectively, the "Content") are owned or controlled by the University of Florida Board of Trustees, which retains all right, title, and interest in and to its Content. The Website and Content are protected by the copyright and trademark laws of the United States and other countries, international conventions, and other applicable laws.
Hospital will not download, display, reproduce, create derivative works from, transmit, sell, distribute, or in any way exploit Content available via the Website for any public and/or commercial use without the prior written permission of the IDOP.
Hospital will not use any trademarks, service marks, names, logos, or other identifiers of IDOP or its employees, licensors, independent contractors, providers and affiliates (collectively, "Affiliates") without the prior written permission of IDOP or the relevant Affiliate. In addition, Hospital will not use IDOP trademarks:
- in, as, or as part of, Hospital’s own trademarks or those of any third parties;
- to identify products or services that are not those of IDOP;
- in a manner likely to cause confusion; or
- in a manner that implies that IDOP sponsors or endorses or is otherwise connected with Hospital’s activities, products, and services or those of third parties.
This Agreement may be modified from time-to-time. The date of the most recent revisions will appear on this page, so check back often. Continued access to IDOP by Hospital will constitute acceptance of any changes or revisions to the Agreement.
This Agreement is construed and enforced in accordance with the laws of the State of Florida.
Hospital has read and understands the foregoing, and agrees to comply with the terms of this Agreement.
